What Is Statutory Compliance in HR?

Statutory compliance in HR refers to the legal framework that organizations must follow with respect to employment, wages, benefits, and workplace conditions, as defined by central and state labor laws. In India, this includes a wide range of laws governing minimum wages, provident fund contributions, employee insurance, gratuity, bonus payments, and working conditions.

Non-compliance can result in financial penalties, legal action, and reputational risk - which is why statutory compliance is a core responsibility of HR and payroll teams.

Key Statutory Compliance Requirements in India

  • Provident Fund (PF): mandatory retirement savings contribution under the Employees' Provident Fund Organisation (EPFO), typically 12% of basic salary from both employer and employee for eligible establishments.
  • Employee State Insurance (ESI): a social security scheme providing medical and cash benefits to employees earning below a specified wage threshold, administered by the ESIC.
  • Professional Tax: a state-level tax on income from employment, applicable in several Indian states.
  • Gratuity: a statutory lump-sum benefit payable to employees who complete five or more years of continuous service.
  • Minimum Wages Act: sets minimum wage rates by state, industry and skill category.
  • Bonus Act: mandates minimum bonus payments for eligible employees based on company profitability.

Why Statutory Compliance Matters

Statutory compliance protects employees' legal entitlements and protects employers from penalties, audits, and litigation. As organizations grow across states, compliance becomes more complex, since PF, ESI and professional tax rules can vary by location and employee wage bands.
